Terms of Service
These terms are an agreement between you and GeeskiAI LLC, a Delaware limited liability company ("ChartForce", "we", "us"). They apply when you create an account, use chartforce.ai, or buy a plan. By doing any of those, you accept them.
1Who may use ChartForce
You must be at least 16 to hold an account and at least 18 to buy a paid plan. If you are using ChartForce for an organization, you confirm you are authorized to bind it, and these terms apply to that organization too.
You are responsible for your account credentials and for everything done under your account. Tell us at once if you think someone else has access.
2Plans, credits and payment
ChartForce has a free plan and paid plans. Paid plans are subscriptions that renew automatically each month until canceled, and are charged through Stripe. Prices are shown on the pricing page in US dollars. Where sales tax or VAT applies to your purchase, it is calculated at checkout from your billing address and shown before you pay.
Generating a chart consumes credits from a monthly allowance that resets each billing period. A chart costs 1 credit whatever type it turns out to be, and a prompt that produces no chart is not charged. Exporting a chart as a video costs 2 credits, charged once for that chart however many times you re-export it; editing a chart, animating it, and exporting it as PNG or SVG (SVG on paid plans) cost no credits. Unused credits do not roll over.
You can cancel at any time from the billing portal in Settings. Cancellation takes effect at the end of the period you have paid for, and you keep access until then. Refund and cancellation terms, including the withdrawal right for consumers in the EU and UK, are in the Refund and Cancellation Policy.
We may change prices with at least 30 days' notice by email. A price change takes effect at your next renewal, and canceling before then means you never pay it.
3Your content
"Your content" means the prompts you write, the files and images you upload, and the charts you produce. You keep ownership of all of it. We claim no ownership over your content or your charts.
You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce and transmit your content, strictly for the purpose of operating ChartForce for you — running the pipeline, generating and storing your charts, sending the necessary parts to the service providers listed at Subprocessors, and showing a chart you publish to the people and websites you choose. The license ends when you delete the content or your account; for a published chart, showing it ends when you unpublish it.
You promise that you have the right to upload what you upload. That matters most for images: uploading a photograph of a person, a company logo, or a chart from a publication requires that you hold the necessary rights or that your use is otherwise lawful. See the Acceptable Use Policy and the Copyright and DMCA Policy.
4What you may do with the charts you make
Charts you generate are yours to use, including commercially — publish them, put them in a report, post them, sell the report they appear in.
Two conditions. First, the underlying data belongs to its source, and some sources attach license conditions such as required attribution; ChartForce bakes the source, dataset identifier and retrieval date into every export so you can meet them, and the conditions per source are listed at Data sources and licensing. Second, exports on the free plan carry a ChartForce watermark, and removing, obscuring or cropping it out is not permitted — upgrade instead.
5Publishing charts
You can publish a chart to people you invite by email and, on paid plans, to websites you allow to embed it. You decide who and which sites, and you are responsible for the access control on your own site: a chart embedded on a page is visible to anyone who can see that page. Allowing a site limits where a chart can appear; it does not keep its data confidential.
You must have the right to publish the data in a chart, including data from sources whose licenses restrict commercial use. When a chart uses one, we ask you to confirm how you are using it before it is published, and we keep a record of that confirmation. See Data sources and licensing.
People you invite sign in to view a chart and must be at least 16. When your plan stops covering a published chart — your paid plan ends, or you move to a plan with fewer — it keeps working for 30 days and then stops, and it comes back if your plan covers it again. We may unpublish a chart that breaches the Acceptable Use Policy or is the subject of a valid copyright notice.
6What we do not promise about the data
ChartForce retrieves data from third-party sources — government statistical agencies, central banks and intergovernmental organizations — and, where you ask it to, reads values from a chart image you upload. We do not control any of those sources and we do not independently verify what they publish.
- We do not warrant that any figure in a chart is accurate, current, complete, or fit for any particular purpose.
- Values read from an uploaded image are estimates produced by a model measuring pixels. They are labeled as estimates in the product and in exports, and they should be treated as approximations, not as source data.
- A source may revise, restate or withdraw its data after we retrieve it. Charts record the date of retrieval so you can tell how old a figure is.
- Automated validation catches many problems and is not a substitute for your own review.
7Acceptable use
The Acceptable Use Policy forms part of these terms. In short: do not break the law with it, do not infringe other people's rights, do not attack or overload the service, and do not use it to produce deliberately misleading charts.
8Availability and changes to the service
We do not offer a service-level guarantee on any published plan, and ChartForce may be unavailable for maintenance, upstream outages, or reasons outside our control. Data sources go down, change their APIs, and rate-limit us; a chart that worked yesterday may fail today for reasons that are not ours.
We may add, change or remove features. If we remove something you are actively relying on, or make a change that materially reduces what a paid plan offers, we will give at least 30 days' notice by email and you may cancel for a pro-rata refund of the unused period.
9Suspension and termination
You can stop using ChartForce and delete your account at any time from Settings.
We may suspend or terminate an account that breaches these terms or the Acceptable Use Policy, that is being used unlawfully, or that is creating a security or stability risk. Except where the breach is serious or we are legally required to act immediately, we will give you notice and a chance to put it right first. If we terminate your paid account other than for breach, we refund the unused portion of the period.
On termination we delete your content according to the retention schedule in the Privacy Policy. Export anything you want to keep before you delete your account.
10Disclaimers
To the fullest extent the law allows, ChartForce is provided "as is" and "as available", and we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy or reliability of data obtained through the service.
Some jurisdictions do not allow the exclusion of certain warranties, and consumers have rights that cannot be excluded by contract. Nothing here limits those rights.
11Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if advised such damages were possible.
Our total liability arising out of or relating to ChartForce is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
12Indemnity
You will defend and indemnify us against third-party claims arising from your content, from your use of ChartForce in breach of these terms, or from your publication of a chart — including a claim that something you uploaded infringed someone's rights. We will tell you promptly about any such claim and let you control the defense, and you will not settle in a way that admits fault on our behalf without our agreement.
13Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Disputes will be brought in the state and federal courts located in Delaware, and both parties submit to that jurisdiction.
If you are a consumer resident in the EU or UK, this does not deprive you of the protection of the mandatory laws of your country of residence, or of the right to bring proceedings there.
Before filing anything, please email us. Most disputes are a misunderstanding about billing and are resolved in a day.
14Changes to these terms
We will give at least 30 days' notice by email before a material change takes effect. Continuing to use ChartForce after that means you accept the new terms; if you do not, cancel before they take effect and we will refund the unused portion of your period.
15General
These terms, together with the policies they reference, are the entire agreement between us about ChartForce. If a provision is unenforceable, the rest stands. Not enforcing something is not a waiver of it. You may not assign these terms without our consent; we may assign them to a successor in a merger or acquisition.
